General Terms & Conditions The Rinz

Article 1– Definitions

1.1 In these terms and conditions (“Terms and Conditions”), the following terms shall have the following meanings, unless expressly stated otherwise:

-Consumer: the natural person who,not acting in the course of a profession or business, purchases Products from The Rinz via the Webshop.

-Agreement: the agreement betweenThe Rinz and the Consumer regarding the purchase and delivery of the Products.

-Products: all products available to order on the Website and in the Webshop and to be delivered by The Rinz.

-The Rinz: the private limited liability company

 The Rinz B.V., registered in Aalsmeer, Chamber of Commerce number: 62752464 - Website: the website of The Rinz, accessible via www.therinz.com and all associated subdomains.

-Webshop: the online store of The Rinz, accessible via the Website.

Article 2– Applicability

2.1 These Terms andConditions, which are presented and accepted by the Consumer before and/or during the ordering process in the Webshop, apply to every offer made by TheRinz through it's Webshop and to every Agreement concluded between The Rinz and the Consumer, unless and to the extent that deviations from these Terms and Conditions have been expressly agreed upon in writing.

2.2 Orders can only be placed via the Webshop for deliveries within the Netherlands.

2.3 If one or more provisions of these Terms and Conditions prove to be null or voidable, the remaining provisions shall remain in full force and effect.

2.4 If you are designated by The Rinz as a “business customer,” these Terms and Conditions also apply to you, provided that additional and/or different terms may be agreed upon. In the event of conflicting agreements, the differing agreements take precedence.

Article 3– Formation of the Agreement

3.1 An Agreement is concluded when the Consumer accepts the offer from The Rinz as shown in the Webshop by placing an order, subject to Article 3.2.

3.2 The Rinz reserves the right, based on factual circumstances and objective grounds, torefuse an order or to attach additional or different conditions to its execution.

3.3 After theConsumer has accepted the offer and successfully completed the payment through the Webshop, the Consumer will receive an order confirmation from The Rinz by email.

Article 4– Right of Withdrawal, Cooling-off Period, and Returns

4.1 The Consumer has a Right of Withdrawal, meaning a cooling-off period of 14 days. Within 14days of receiving the Product, the Consumer may dissolve the Agreement without stating reasons and thereby cancel the purchase.

4.2 During the cooling-off period, the Consumer shall handle the Products carefully, only opening or unpacking them to the extent necessary to establish the nature and characteristics of the Products. This means that Products may not be connected or installed. 4.3 If the Consumer does not comply with the obligations inArticle 4.2, the Products will be subject to depreciation, for which theConsumer is liable. This means that if the Consumer returns used Products within the cooling-off period, they are no longer entitled to (full) reimbursement of the purchase price.

4.4 If the Consumer wishes to exercise their Right of Withdrawal, they must notify The Rinz within the cooling-off period using the model withdrawal form available on the Website or in another clear written manner.

4.5 The Consumer must return the Products in the original packaging as soon as possible, but no later than 14 days after the notification referred to above.

4.6 The risk and burden of proof for proper and timely exercise of the Right of Withdrawal rests with the Consumer.

4.7 If the Consumer exercises the Right of Withdrawal, they may return the Products free of charge in the original packaging.

4.8 Upon exercise of the Right of Withdrawal, The Rinz will reimburse the purchase price of theProducts within 14 days of receiving the returned Products.

4.9 Refunds will be made using the same payment method as used by the Consumer, unless the Consumer agrees to another method.

Article 5– Delivery

5.1 The Rinz takes the utmost care in receiving and delivering orders.

5.2 The delivery times stated on the Website are indicative and do not entitle the Consumer to dissolution or compensation in case of delays, unless expressly agreed otherwise in writing.

5.3 The Rinz will execute accepted orders with due speed, but within 90 days after receipt,unless a longer delivery period has been agreed. In case of unreasonable delay,not due to force majeure, the Consumer may dissolve the Agreement in writing. Incase of force majeure, The Rinz will refund the purchase price within 5 to 10business days.

5.4 The delivery address is the address provided by the Consumer at the time of ordering. 5.5 In case of force majeure, the agreed delivery time is extended by the duration of the force majeure situation.

5.6 If the Consumer fails to provide the information or instructions necessary for delivery, The Rinz is entitled to cancel the order.

Article 6– Payment

6.1 Prices in the Webshop include VAT but exclude shipping and transaction costs. The agreed price applies only to the placed order. The Rinz reserves the right to change Webshop prices for Products, meaning future orders may have different prices.

6.2 Payments must be made using the payment methods specified in the Webshop.

6.3 The Consumer must promptly notify The Rinz of any inaccuracies in payment data, address, or contact information.

6.4 If The Rinz owes the Consumer any amount,it may offset this against outstanding amounts owed by the Consumer.

Article 7– Warranty

7.1 The Rinz guarantees that the Products it delivers meet the usual requirements and standards. This warranty is limited to 2 years from the date of purchase. After this period, The Rinz can no longer guarantee quality.

7.2 If there are problems with the Products, The Rinz will determine whether there is a defect.If so, The Rinz will replace the Product free of charge, provided it is notified within the period specified in Article 10.1.

7.3 Warranty-related work will only be carried out during normal working hours.

7.4 This warranty expressly excludes defects caused by misuse, insufficient maintenance, negligence, accidents, and/or normal wear and tear. “Misuse” includes, but is not limited to, unauthorised use of the Products and/or failure to follow installation and replacement instructions.

Article 8– Liability

8.1 Products must always be installed, connected, and/or used in accordance with the accompanying instructions.Installation, connection, and/or use is at the Consumer’s own risk.

8.2 If Products are installed, connected, and/or used for other purposes, after expiry dates, or in violation of these Terms and Conditions and/or instructions, The Rinz is not liable for resulting damages.

8.3 Immediately upon receipt, the Consumer must check the Products for visible defects and/or damage. If present, theConsumer must not use the Products and must contact The Rinz for replacement.

Article 9– Force Majeure

9.1 The Rinz is not liable for loss or damage resulting from circumstances not attributable to it's fault and which cannot reasonably be attributed to it under law, legal acts, or common opinion.

9.2 If either party is affected by force majeure and invokes it, each party may dissolve the

Agreement without judicial intervention if the situation continues and no foreseeable end is insight.

Article 10– Complaints

10.1 Complaints regarding the execution of the Agreement and/or delivered Products must be submitted in full and clearly described to The Rinz within 2 months after theConsumer has discovered the defects.

10.2 Complaints submitted within this period will be answered within 14 days of receipt. If more time is required, The Rinz will send a confirmation and an indication of when the Consumer can expect a detailed response.

10.3 The Consumer must give The Rinz at least4 weeks to resolve the complaint in mutual consultation.

Article 11– Customer Data

11.1 The Rinz processes personal data provided by the Consumer for the performance of the Agreement. For more information, the Consumer can consult The Rinz’s privacy policy via: https://www.therinz.com/privacy-policy

11.2 The Consumer is obliged to keep their customer and (if applicable) payment details stored in the Webshop account up to date.

Article 13– Governing Law and Jurisdiction

13.1 All legal relationships between The Rinz and the Consumer are exclusively governed byDutch law.

13.2 Disputes between The Rinz and theConsumer will be settled by the court of the defendant’s place of residence.

Article 14– Amendment of Terms and Conditions

14.1 The Rinz is entitled to amend or supplement these Terms and Conditions at any time. The version of the Terms and Conditions available on the Website and Webshop is the most current version. The Consumer can view, download, and print these Terms and Conditions via the Website and Webshop.

We understand that you would like to know why we request certain information from you and how we use it. We are happy to explain this. How The Rinz Protects Your Data We protect the personal data you provide to us using various techniques. In addition, we ensure that within The Rinz only those employees who need access to your data can view it. This way, people who have no involvement with your data cannot access it. If we share your data with another party, as explained below when and why we do this, we require that this party handles your data with the same level of care as we do and only uses it for the intended purpose. What Data Does The Rinz Use and Why?

We use your data for various purposes, which we explain below. We use both the data you provide to us and data we collect ourselves, such as information about your visit to our website.

Registering The Rinz When you purchase a The Rinz product, you can register it in your “My The Rinz”account. This allows you to activate the standard two-year warranty and ensures we can easily provide service in the future. These details are stored in our service database.We need this information so our service department can quickly assist you with any issues or questions. Based on your data, they can identify which reservoir and tap you have, enabling them to provide a suitable solution more efficiently. The data we collect includes:

* First and last name

* Preferred salutation

* Email address

* Address

* Phone number

* Serial number of your The Rinz

* Whether you have a new or existing toilet or bathroom

* Where you purchased your The Rinz

* Date of purchaseYou may request deletion of this data at any time.

Service Contact Form.

If you have questions about The Rinz or encounter an issue, you can contact our service department through your “My The Rinz” account. The form asks for ad escription of the issue or question, the product involved, and any attachments. Like registration data, this information is stored in our service database. This allows our service team to provide you with the best possible support. Were tain your data for as long as you remain a customer. You can request deletion at any time.

Review Policy

We value customer feedback and gather it through reviews. Below is our policy on reviews and how we prevent fake reviews:

* Reviews must come from customers who have experience with The Rinz. Customers who made a purchase and subscribed to commercial emails will receive a request after two months to leave a review via Google, Trustpilot, Feedback Company, or 5 star specialist.

* The Rinz does not post reviews itself, nor are reviewers paid.

* Reviews are never deleted, even if they are negative.

* Reviews are regularly monitored and responded to.

* The average rating is calculated by dividing the total score by the number of reviewers.

Newsletter

When registering your The Rinz, you can opt in to receive our newsletter. If you consent, we will send newsletters to the email address you provided. These may include news, recipes, and applications.You can unsubscribe at any time by clicking the “unsubscribe” link in the newsletter or by contacting customer service.

Improving the Website

We aim to make our website as user-friendly as possible. To do this, we collect information by placing cookies, small text files stored in your browser. We request your consent for this during your first visit.We collect data such as:
